Below is the form for the exclusion of liability.
CONDITIONS OF PARTICIPATION AND WAIVER OF LIABILITY ON THE PART OF VISITORS
for journeys as a passenger during BRAZZELTAG at the Technik Museum Speyer on 10th and 11th May 2025, hereinafter referred to as the „Event“.
As a passenger, I confirm with my signature that I am aware of the following circumstances and accept the following provisions:
I am aware that journeys as a passenger involve risks despite all safety measures and caution.
I assure that I am sufficiently healthy to meet the requirements for journeys as a passenger. In particular, I do not suffer from any neurological diseases or diseases of the cardiovascular or skeletal system.
The instructions of the organiser‘s staff – in particular, those of the driver of the vehicle – must be followed unconditionally. In the event of a violation, the journey may be interrupted, and overall exclusion from the rest of the event may take place.
WAIVER OF LIABILITY
The organiser, its legal representatives and its vicarious agents are only liable in the event of intent or gross negligence and in the cases mentioned below.
The above limitation of liability does not affect the liability of the organiser for damage resulting from injury to life, limb or health and for any breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment enables the proper execution of the contract in the first place and on adherence with which the participant regularly relies and may rely (these include the establishment, monitoring and operation of the site according to a standard which is ordinarily to be expected for the type of site in question and using reasonable means; the proper selection, instruction and monitoring of the vehicle drivers; the safety monitoring of the vehicles used; the contractual provision of the agreed additional and special services, and the contractual commissioning of any service providers). In the event of a simply negligent breach of these essential contractual obligations, the liability of the organiser is limited to the damage that is typical for the contract and which is foreseeable based on the nature of the contract. However, at any time before damage occurs, the passenger has the option of increasing this limit with respect to the organiser accordingly by means of an official notice of endangerment or a declaration of value in writing, at least in electronic form (e.g., by email).
The above exclusions and limitations of liability also apply to the liability of the organiser for its bodies, employees and assistants/vicarious agents as well as to the personal liability of the bodies, employees and assistants/vicarious agents of the organiser.
I release the organiser of the Event, its legal representatives and its assistants/vicarious agents from any liability towards third parties and indemnify the aforementioned group of persons from all claims of third parties insofar as these third parties suffer damage for which I am responsible. This also applies to the costs for appropriate legal defence.
AS A LEGAL GUARDIAN
Insofar as I, as the legal guardian of a minor participant, sign on their behalf, I assure that the other legal guardian – insofar as they do not sign themselves – is aware of this declaration, agrees with its content, and has authorised the signatory to submit the declaration for that other legal guardian as well.
CONSENT TO REPORTING IN THE MEDIA
I consent to the free use of my image and voice, for all current and future media, for photographs, live broadcasts, programmes and/or image and sound recordings created by the organiser or its representatives for, e.g., public relations work, reporting, advertising measures or security reasons in connection with the Event. I hereby transfer the unrestricted right of use in this respect to the organiser.
